Under this statute, communications made in mediation are privileged and not subject to discovery or admissible as evidence in court. Mediators, mediation parties, and non-party mediation participants may refuse to disclose or prevent others from disclosing mediation communications. The statute provides exceptions to this privilege, as well as situations in which the privilege may be waived. The statues also addresses mediator reports, confidentiality, conflicts of interest, and participation in mediation.
