Supreme Court of Montana Rules on Arbitration of Fee Disputes

Under this rule, any dispute between attorney and client over fees in the amount of $500 or more may be arbitrated. The court shall appoint qualified persons to an arbitration panel, and the parties to the dispute shall select the arbitrators from a list of panel members provided by the court. The rules outline procedures for conducting the arbitration hearing, including scheduling, attendance requirements, and recording of the proceedings, as well as procedures for rendering decisions. The rules also provide requirements for confidentiality and arbitrator immunity.
