Not on Trees, But Mediators Grow: Assuring Best Practices in Court-Annexed Mediation

In 2013, the Mediation Program for U.S. District Court for the Southern District of New York partnered with the Alternative Dispute Resolution Committee of the New York City Bar Association to develop a pilot program for systematic evaluation of mediator competency. To evaluate mediators, a panel of highly experienced mediators observed actual mediations conducted by court mediators. The results of the pilot program was the creation of a Mediator Evaluator Protocol which went into effect in January 2016. This report describes how the pilot program worked, the results of the evaluation and includes documents from the pilot program.
