North Dakota Rules of Court Rule 8.9: Roster of Alternative Dispute Resolution Neutrals

Under this rule, the state court administrator is to maintain and monitor a roster of neutrals for civil arbitration, civil mediation, and domestic relations/contested child proceedings mediation, which is to be updated annually. The rule specifies the various qualifications and training requirements that the three types of neutrals must meet in order to be included on the roster. It also specifies that neutrals must continue to update their training, and that parties may select a neutral who is not on the approved roster. Finally, the rule outlines the enforcement process for the North Dakota Code of Mediation Ethics.
