Mediation Success: An Empirical Analysis

This article examines the results of a survey of more than 500 members of the American Bar Association Forum on the Construction Industry to detect the determinants of mediation success. It begins by reviewing previous quantitative and qualitative research on the determinants of mediation outcome in divorce, labor and small claims cases, then discusses the results of the above-mentioned survey. The author utilizes the results to create an empirical model that explains settlement of construction disputes that go through mediation. The results seem to indicate that process is the key variable in mediation success.
