Mediating Probate Disputes: A Study of Court Sponsored Programs

Mediation has been less often used to resolve probate disputes than disputes arising from other areas of family law. This study examines the impediments and the benefits of such mediation through overviews of six court-sponsored probate mediation programs and the feedback of attorneys who have participated in them. It then uses the attorney feedback to discuss how best to address some common issues in developing probate mediation programs in the courts.
