Maine Rules of Civil Procedure: Rule 93 - Foreclosure Diversion Program

This rule governs foreclosure actions against owner-occupant defendants who have been ordered to mediation. The rule outlines the responsibilities of the program's manager, mediator qualifications, mediator reports, and the creation and completion of forms, among other topics. Borrowers must file an answer with the court within 20 days of being served a summons and complaint, in which case a mediation will be scheduled. The court may also use its discretion in scheduling a mediation if the answer has not been filed within the alloted time. The borrower may be required to attend an information session prior to mediation, and both the borrower and lender are expected to negotiate in good faith.
