This article summarizes a study examining the legal ethics of lying and candor in legal negotiations and settlement. Inside Litigation conducted 15 total interviews of current practitioners, including nine law professors, five experienced litigators, a federal circuit court judge, and a U.S. magistrate. Each interviewee was asked about their opinion on what a lawyer should do in each of four hypothetical settlement situations. The article summarizes each of the ethical questions and the answers from the interviewees, revealing a range of reactions and opinions to the questions and responses to lying during settlement conferences.
