Illinois Statutes 750 ILCS 5/101-802 Illinois Marriage and Dissolution of Marriage Act

Section 5/508(c) of this statute addresses client responsibility and the collection of attorneys fees. In cases where there is a controversy over fees and costs, no final hearing is permitted unless the party and their former counsel have submitted to some form of alternative dispute resolution including mediation, arbitration, or other court approved ADR procedure. There are two exceptions to this rule. The first is that in any circuit court for a county with a population that exceeds 1,000,000 the requirement of the controversy being submitted to ADR is mandatory unless the client and the counsel affirmatively opt out. The second exception is that in any circuit court, the requirement of the controversy being subitted to ADR is mandatory only if niether the counsel nor the client affirmatively opt out.
