Part 8 - Domestic Relations (Rule 8.16 and 8.17): Provides information on the Circuit's Family Mediation Program. Under these rules, any contested issue of parental responsibility, custody, visitation, guardianship, removal or access to children must go to mediation unless the case is determined to be ineligible due to concerns about safety or competency. Cases cannot proceed to a judicial hearing on permanent contested issues until the mediation process has been concluded. The rules call for the parties to select a mediator from the court's list of approved mediators. Mediator qualifications to be on this list are outlined. Mediation communications are to be confidential, with some limitations.
Part 12 - Mandatory Residential Foreclosure Mediation: Provides information on the Circuit's Mandatory Foreclosure Mediation Program. All parties in residential foreclosure cases must participate in the mediation program. The rules outline mediation procedures, mediator qualifications and compensation, and confidentiality.
