Getting Landlords and Tenants to Talk - The Use of Mediation in Eviction

Brian Bieretz; Kimberly Burrowes; Emily Bramhall. Urban Institute, Apr. 1, 2020
https://www.urban.org/sites/default/files/publication/101991/getting-landlords-and-tenants-to-talk_3.pdf

This report explores the use of mediation in eviction cases. To gather research, authors interviewed representatives from 14 organizations involved in mediation programing to discuss the mediation process in housing court, identify how programs recruit mediation participants, the partnerships needed to make mediation successful, and what prevents programs from expanding their services.

Furthermore, the report explores how mediation can be beneficial in eviction cases, identifies power imbalances in landlord-tenant disputes, best practices for mediators and mediation programs, and includes recommendations for making eviction mediation successful. These recommendations include building relationships in the community, using marketing campaigns to increase awareness of eviction medaition, increasing access to services with online mediation, and identifying local policy changes that can make additional support (like financial resources) available.
