Fitting the Forum to the Fuss: A User-Friendly Guide to Selecting an ADR Procedure

This article advises attorneys about the selection of an ADR process once they have identified their client's case as one that is appropriate for ADR. The authors believe that most common tort claims that do not raise unique legal issues can be addressed by ADR. The article explains that the most important way to decide which form of ADR is appropriate for the case is to evaluate the client's goals. The authors set out a chart listing common client objectives and assigning number values to ADR forums accordingly. The article also identifies common impediments to settlement and sets out a chart for the corresponding ADR forums that would best alleviate those obstacles. The article then provides three case examples to demonstrate the use of this forum selection system.
