This article discusses the differences between facilitative mediation and evaluative mediation. In particular, the author says facilitative mediation addresses the emotional component in a dispute whereas evaluative mediation does not. The author sets forth the characteristic aspects of facilitative mediation, discusses when in the life of a dispute facilitative mediation should be considered and describes the types of cases appropriate for facilitative mediation. The article also includes resources on facilitative mediation in Oregon.
