Co-Mediation: Positives, Pitfalls and Lessons Learned

Keys, Bianca. ADR Bulletin,

This article explains co-mediation and the benefits to be gained by the mediator in using this method. As described by the author, co-mediation is the concept of two or more mediators working on the same matter, essentially as a team rather than as two individuals. Co-mediators can benefit from the diversity between themselves and the parties, with each individual bringing a different perspective to the mediation. The author then describes how attorneys can implement the teamwork employed by co-mediators while advocating for their clients during negotiations and mediations. By asserting their own position as well as empathizing with the other party, attorneys and clients can ensure that the negotiation process is beneficial to both sides.
