The NAARB Task Force on ADR in employment developed a mediation and arbitration protocol for due process in statutory disputes regarding employment issues. The goals for this protocol are to provide fair and efficient resolution of employment statutory disputes and to reduce court and administrative agency case backlog. The protocol addresses pre- or post-dispute arbitration, right of representation, mediator and arbitrator qualification, and scope of review.
