This statute creates the position of director of dispute resolution, who shall work for the office of judicial administration. Additionally, it creates an advisory council whose role is to advise the director on administration and policy development, consult with state agencies, and assist the director in providing technical assistance. Further, it makes confidential all verbal or written information transmitted between any party and the neutral, with some exceptions. All neutrals and staff members are immune from civil suits arising from any statement or decision made in the process of dispute resolution unless gross negligence or malicious purpose is present. The Act also provides for sanctions to be placed against those who have not participated in mediation in good faith.
