Neutrals: Lawyers who have practiced for at least 15 years or judges who have served in Cook County for at least 15 years. Mediators are also required to have completed a 40 hour mediation training program and certify that they have served as a mediator on at least 10 occasions in major probate cases.

The Cook County Probate Division Court-Annexed Mediation Program was established in 1995 and is governed by Part 24 of the Court's local rules and Illinois Supreme Court Rule 99.
Judges may assign the following matters in the Probate Division to the mediation program: decedent estates, minor guardianship matters, adult guardianship matters after a finding of adjudication has been entered. Cases may be referred to mediation at any time and the mediation will take place at 5 weeks after being referred to mediation. Pursuant to the program's rules, mediation must be complte within 7 weeks after the parties first mediation session.
Within 21 days after being referred to mediation, the parties must file a stipulation designating a mediator for their case. Parties are not required to select a mediator from the court's certified list of mediators. If the parties are able to agree upon a mediator, than the parties and the mediator must agree in writing to a rate of compensation for the mediator. However, in the event the parties are unable to agree upon a mediator for their case, then the court will assign a court-certified mediator for their case. If the court appoints a mediator to the case, the parties will first attempt to reach an agreement regarding the rate of compensation. In the event the mediator is a person appointed by the court, the rate for the mediator will be $250 an hour. Unless otherwise agreed to by the parties or upon good cause shown, each party shall pay a proportionate share of the total charges of the mediator.
If the parties are able to reach either a full or partial agreement during mediation, that agreement shall be filed with the court.
