The 4th Judicial Civil Mediation Program was enacted in June 2011. Neutral mediators in this program may be selected by the parties or appointed by the court. Judges may order any issue in a contested civil matter including Law, Chancery, or Probate to mediation. Unless otherwise ordered by the court the first mediation conference shall be held within 8 weeks of the Order of Referral to mediation. At least 10 days before the conference, each party will present the mediator with a brief list of issues as to each party. Within 28 days after the Order of Referral, the mediator shall notify the parties in writing of the date and time of the mediation confrerence. The parties or their attorneys may initate contact with the mediator to set a mutually convenient date for mediation.
There is also a mediator pro bono requirement for this program that requires each court-certified mediator to agree to mediate without compensation in cases whether the court has determined that mediation might be beneficial and the parties are indigent.
