Civil mediation began in McHenry County in 1996, when it was part of the 19th Circuit. Under this program, any civil case valued more than $50,000, can be referred to mediation by order of the court or by stipulation by the parties. A party may move to dispense with court-ordered mediation if mediation has already been tried, if the dispute is a matter of law only, or for any other good cause shown.
Once a case is referred to mediation, the parties may agree upon a mediator who is either on the court-approved roster or who is reviewed and accepted by the judge. If the parties cannot agree on a mediator within 14 days, the judge selects the mediator for them. In order to be approved for the court's roster, mediators must be a retired judge or a member of the Illinois bar with at least eight years experience as a lawyer, must have completed a court-approved mediator skills training, and must be of good moral character.
The mediation must take place within eight weeks of the referral. Prior to referral, the parties are required to submit a summary of the case that includes the issues for each party. Each party, or representatives with full settlement authority, is required to attend the mediation, as well as the counsel of record and representative for the insurance company for any insured party. All written and oral communications that occur during the mediation are considered confidential and cannot be used as evidence in any succeeding court proceedings.
